Defendants may request the court appoint an expert witness to review lab reports and other data received from the prosecution in discovery, explain this material, identify any areas of weakness, and assist defense counsel in preparing to cross-examine the state's expert witness. The defense expert may conduct independent retesting on the DNA evidence, and may (or may not) testify at trial.
