If a DNA profile is developed from a lawfully obtained sample, this profile may be compared to DNA profiles from unrelated, unsolved crimes. The law appears to allow evidence legally obtained from one case to be used in other cases. Courts have reasoned that the subsequent use of a DNA profile does not entail a 4th Amendment search or seizure violation [Wilson v. State, 752 A.2d 1250; 132 Md. App. 510 (Md. 2000); Smith v. State, 734 N.E.2d 706 (Ind. Ct. App. 2000)].
