In 2001, Wisconsin adopted legislation mandating preservation of
biological evidence in all criminal cases while any person remains in custody or under supervision in cases connected to that evidence. The legislature also created a right to postconviction DNA testing in any case in which favorable DNA results might create a reasonable probability of a different outcome. In Wisconsin, at least six people have now had their convictions for rape or murder reversed, in whole or part, by postconviction DNA testing. ca/ncf
