Description of original award (Fiscal Year 2023, $692,889)

Montclair State University (MSU) proposes to examine the variation of resentencing and “second look” sentencing models—for youth and emerging adults serving lengthy sentences (10 years or more)— nationwide; and an in-depth examination of the efficacy of these models in five jurisdictions. The purpose of the proposal is to better understand the process by which resentencing decisions are made, role of various parties in resentencing, and the factors that impact decision making. This would allow for expansion of these laws to states currently considering “second look” legislation. Project activities include a state-by-state analysis of resentencing and second look legislation/case law; implementation evaluations of the implementation of resentencing in 5 jurisdictions, interviews with returning citizens on their resentencing and reentry experiences; and cost analyses of the impact of early release. Expected outcomes include a comprehensive overview of resentencing models; policies for best practices in resentencing; guidance for legislators and policymakers looking to implement second look laws, and a development of best practice guides for attorneys engaged in resentencing. MSU will partner with the Center for Justice Innovation (CJI) who will be involved in stakeholder interviews, and developing practitioner partnerships, and the Campaign for Fair Sentencing of Youth who will assists in the national policy scan. The partner sites will include the New Jersey Office of the Public Defender, the Maryland Office of the Public Defender, the Defender’s Association of Philadelphia, State Appellate Defender’s Association in Michigan, and the Second Look Project in the District of Columbia.
