DNA can be used in post-conviction proceedings. Just as DNA can be used to establish bad acts, the existence of such prior bad acts or crimes could be introduced in a parole proceeding to show the defendant's criminal behavior or anti-social character warrants denying parole. Also, such evidence could be presented in a sexually violent predator proceeding to demonstrate the defendant poses a risk to society.
